Ward v. Circus Circus Casinos, Inc., 04-17098

In an action brought against plaintiffs' employer, Circus Circus Casinos, setting forth state law tort claims arising from alleged physical force used against them by defendant's security guards, summary judgment and an order of garnishment in favor of the employer are reversed where, contrary to the district court's ruling, section 301 of the Labor Management Relations Act does not preempt any of the workers' claims.
