United States Ninth Circuit

US v. Jones, 06-30024

Denial of defendant's motion to withdraw his plea to wire fraud is affirmed where, even though defendant did not possess a fraudulent intent when he received the money at issue, his fraudulent appropriation of the funds still satisfied the elements of 18 U.S.C. section 1343, and the district court did not abuse its discretion in denying his motion to withdraw.
