Hosseini v. Gonzales, 03-73734

Petition for review of denial of asylum, withholding of deportation, adjustment of status and withholding and deferral of deportation under the Convention Against Torture is denied where petitioner committed immigration fraud and engaged in, or was likely to engage in, terrorist activity, but granted where the BIA failed to articulate sufficiently the bases for its denial of withholding of deportation under the INA and petitioner's work for an opposition party made it more likely than not that he would be tortured if he returns to Iran.
