Puri v. Gonzales, 05-36182

Dismissal of petition for writ of habeas corpus challenging a deportation order is affirmed where: 1) the district court lacked jurisdiction over habeas petitions under the REAL ID Act; 2) the Act does not violate the Suspension Clause by removing jurisdiction from the district courts since review by a court of appeals provides an adequate substitute; and 3) the case did not warrant a transfer to the court of appeals since petitioner also had a petition for review before the court.
