Stephens v. Herrera, 04-56232

Dismissal, for lack of jurisdiction, of a habeas corpus petition is affirmed where petitioner failed to make out a claim of actual innocence, and thus, he had not properly invoked the "escape hatch" exception of 28 U.S.C. section 2255 that would permit him to file a petition for habeas corpus under 28 U.S.C. section 2241.
