Hovey v. Ayers, 03-99001

Denial of a petition for a writ of habeas corpus seeking relief from a conviction and death sentence for first degree murder during the course of a kidnapping is reversed in part where the district court erred in concluding that a deficient performance of counsel in the penalty phase did not prejudice petitioner.
