Pickern v. Pier 1 Imports (U.S.), Inc., 04-17118

Summary judgment for defendants, a retail store operator and landlord, on a claim brought by a visually-impaired and mobility-impaired woman under the Americans with Disabilities Act (ADA) is affirmed where the district court: 1) properly ruled that the defendants were not required to build an access ramp across a city-owned and operated strip of land; and 2) did not err in finding that plaintiff failed to provide the defendants with adequate notice of new ADA allegations.
