United States Ninth Circuit
US v. Lyons, 04-50157
A conviction for mail fraud involving fraudulent celebrity memorabilia is affirmed where there was sufficient evidence for a rational jury to conclude beyond a reasonable doubt that defendant sent an individual several posters bearing forged celebrity signatures fully aware that he would sell the posters as though they were genuine. Defendant's sentence is vacated pursuant to Booker.
