US v. Carty, 05-10200

Post-Booker, when imposing a sentence, a district court must provide on the record some articulation of its consideration of the 18 U.S.C. section 3553(a) factors and explanation of the reasons underlying its sentence selection. A conviction for sexual abuse is affirmed over claims of error regarding the sufficiency of the evidence, and the sentence is remanded pursuant to a claim that it was imposed in violation of Apprendi and Booker.
