Soldano v. US, 03-17391
In a suit against the government under the Federal Tort Claims Act for damages arising out of a serious motorcycle accident that occurred on a major road in Yosemite National Park, summary judgment for defendants is reversed in part where the district court erred in finding that the discretionary function exception barred plaintiffs' claim that the government negligently set the speed limit for a road.
