United States Ninth Circuit

Reno Air Racing Ass'n, Inc. v. McCord, 04-16001

An award of damages and a permanent injunction against defendant due to his infringement of two trademarks belonging to plaintiff is affirmed, but a contempt finding and imposition of sanctions pursuant to a finding that defendant had violated an ex parte temporary restraining order (TRO) is reversed where the TRO was improvidently issued because it failed to comport with the notice and specificity provisions of Federal Rule of Civil Procedure 65.
