United States Ninth Circuit

Kenna v. US Dist. Court for the Cent. Dist. of California, 06-73352

A petition for a writ of mandamus pursuant to the Crime Victims Rights Act requesting that a district court be ordered to release the entire presentence report (PSR) of a criminal defendant to petitioner is denied where the district court did not abuse its discretion or commit legal error in rejecting a claim that the CVRA confers a general right for crime victims to obtain disclosure of the PSR, or in finding that petitioner had not demonstrated that his reasons for requesting the PSR outweighed the confidentiality of the report under the traditional "ends of justice" test.
