United States Ninth Circuit
Cont'l Ins. Co. v. Fed. Express Corp., 03-57162, 03-57214
The ratification of the Montreal Protocol No. 4 brought The Hague Protocol into full force and effect in the U.S. on March 4, 1999. A stipulated judgment in favor of an insurer for goods lost in shipment by a carrier is vacated where the district court erred by applying the Original Warsaw Convention to the matter when the Hague Protocol was in force at the time the claims at issue arose.
