Denial of a motion to dismiss a class action alleging constitutional violations brought by persons civilly committed and awaiting commitment in a state hospital pursuant to California's Sexually Violent Predators Act is reversed in part where defendants had qualified immunity from suit on plaintiffs' Ex Post Facto, Double Jeopardy, and Eighth Amendment claims.
