US v. Novak, 04-55838

The Mandatory Victims Restitution Act, in conjunction with 18 U.S.C. section 3613, constitutes a statutory exception to ERISA's anti-alienation provision. An order quashing a writ of garnishment of defendant's benefits under a pension plan subject to ERISA is reversed.
