United States Ninth Circuit
US v. Gourde, 03-30262
In a prosecution for possession of child pornography, a denial of a motion to suppress images seized from defendant's home computer is affirmed over a claim that an affidavit in support of the search lacked sufficient indicia of probable cause since it contained no evidence that he actually downloaded or possessed child pornography.
