Qwest Corp. v. City of Surprise, 04-16940
Summary judgment for municipal defendants on plaintiff-communication company's claim that defendants' telecommunications licensing and franchise ordinances are preempted by federal law is affirmed where certain amendments exempted plaintiff from the ordinances, rendering plaintiff's claims moot. Additionally, disputed charges imposed on plaintiff are taxes, and thus the Tax Injunction Act deprived the district court of jurisdiction to invalidate the taxes.
