United States Ninth Circuit

Yahoo! Inc. v. La Ligue Contre Le Racisme et L'Antisemitisme, 01-17424

In an en banc panel decision involving a dispute between a French civil liberties groups and a US internet service provider arising out of the web-display of Nazi memorabilia, the US district court properly exercised personal jurisdiction over two of the French parties. A plurality of the en banc panel concludes that the case is not ripe under the criteria of Abbott Laboratories v. Gardner, 387 U.S. 136, 149 (1967).
