US v. Alferahin, 04-10590

Defendant's conviction for knowingly procuring naturalization contrary to law is reversed where a submission of incomplete jury instructions was plain error, and defendant's attorney provided constitutionally deficient assistance when he declined a judge's offer to instruct the jury on the element of materiality in the charged crime.
