Kroske v. US Bank Corp., 04-35187

The dismiss-at-pleasure provision of the National Bank Act is repealed by implication to the extent necessary to give effect to the Age Discrimination in Employment Act; therefore, summary judgment for defendant on an age discrimination claim under the Washington Law Against Discrimination is reversed because plaintiff's claim was not preempted by the National Bank Act.
