US v. Labrada-Bustamante, 04-30082

Defendants' sentences for drug related offenses are vacated and remanded for resentencing where district court: 1) erred in allowing one defendant to collaterally attack a previous conviction, and 2) during sentencing also clearly indicated that it felt constrained by mandatory sentencing guidelines.
