HIGGINS v. VORTEX FISHING SYS., INC., 03-15487

The bankruptcy court's decision, awarding both trial and appellate attorney's fees after the dismissal of plaintiffs failed Petition for Involuntary Chapter 7 bankruptcy, was proper with respect to the award of fees related to the initial litigation. However, the awarding of fees associated with the subsequent appeals was an abuse of discretion.
