United States Ninth Circuit
CHETEJUAREZ v. ASHCROFT, 02-72506
In a deportation case, the Court reversed denial of plaintiff's motion to reopen, finding that because plaintiff has two United States citizen children and strong ties to the community, compelling circumstances exist in support of remand for consideration of plaintiff's application for suspension of deportation.
