The Court reversed the Board of Immigration Appeals denial of plaintiff's applications for asylum, withholding of removal, and protection of the Convention Against Torture; the Court granted the petition for review because the record compels a finding that plaintiff has suffered from past persecution and that he more likely than not will be tortured if he is returned to Burma.
