United States Ninth Circuit

CITY SOLUTIONS INC. v. CLEAR CHANNEL COMMUNICATIONS, INC., 03-15249, 03-15321

District court erred in granting JMOL to defendant on the fraud claim, as there was a legally sufficient basis for a jury to find that plaintiff might have won the contract for a citywide news rack project absent defendant's fraudulent conduct. Denial of JMOL on the unfair competition claim is affirmed.
