United States Ninth Circuit

TAWADRUS v. ASHCROFT, 02-72349

The IJ's failure to properly obtain a knowing and voluntary waiver of counsel created a level of prejudice tantamount to a violation of Egyptian alien's due process rights; petitioner was unable to present a succinct and internally consistent account of his persecution claim without the guidance of an advocate.
