MEDINA-MORALES v. ASHCROFT, 02-73924

The BIA violated its own precedent by looking to the strength of Honduran alien's relationship to his stepfather in denying his motion to reopen removal proceedings. In such cases, the BIA has said that "no qualifications beyond a valid marriage creating the steprelationship should be imposed."
