United States Ninth Circuit

CASWELL v. CALDERON, 02-17177

Prisoner's Ex Post Facto claim, challenging the California Board of Prison Terms' 1986 calculation of his term of confinement, is moot, because he has already served the sentence that the Board initially imposed and remains in prison only because his parole release date was subsequently rescinded. He is granted leave to add a due process claim.
