District court erred in denying plaintiff's summary judgment motion concerning a permit to extend an existing oil refinery dock. The matter must be remanded with an injunction freezing tanker traffic pending a full environmental impact statement considering the impact of increases in tanker traffic, and a reevaluation of the dock extension's potential violation of the Magnuson Amendment.
