United States Ninth Circuit

Material questions of fact exist with regard to whether defendant-employer created and failed to remedy a racially hostile working environment, and with regard to whether defendant's failure to promote plaintiff was based on racial discrimination. Summary judgment for defendant on those two claims is reversed.
