United States Ninth Circuit

MARTIN v. CITY OF OCEANSIDE, 02-56177

Defendants-officers reasonably believed that someone inside plaintiff's home was potentially in need of "emergency aid," and in entering the home they were motivated by a desire to assist that person rather than gather evidence. Summary judgment on the basis of qualified immunity is affirmed.
