A violation of the California Annoy/Molest misdemeanor statute, California Penal Code section 647.6(a), does not constitute the commission of the aggravated felony of "sexual abuse of a minor." Defendant was therefore eligible for discretionary relief from deportation under 8 U.S.C. section 1229b(a).
