Contributory copyright liability claim, arising after plaintiff's short stories were posted on a peer-to-peer file sharing network to which defendant provides access, is remanded. Summary judgment was improperly granted to defendant regarding its threshold eligibility for the safe harbor limitations of liability under the Digital Millennium Copyright Act.
