JOHNSON v. W.L. GORE & ASSOCS., INC., 02-17094

The long-standing "elapsed-time method" of calculation does not violate ERISA's vesting and benefit accrual requirements; defendant employer violated neither the elapsed-time regulation nor its own stock ownership and pension benefit plan. Summary judgment for defendant is therefore affirmed.
