SMITH v. PACIFIC PROPS. & DEV. CORP., 03-15656
A disabled person seeking to enforce rights created by section 3604(f)(2) of the Fair Housing Amendments Act need not have an interest in actually purchasing or renting a given property or dwelling in order to allege a discriminatory violation. A non-profit corporation may also have standing, separate and apart from that of its "testers," to allege violations of the Act.
