United States Ninth Circuit

42 U.S.C. section 1983 remedies are available under the Telecommunications Act (TCA) because the TCA does not contain a comprehensive remedial scheme; it grants no remedies beyond procedural rights. By enacting TCA section 601(c)(1), Congress indicated its affirmative intent to preserve section 1983 remedies.
