United States Ninth Circuit
AM. ACAD. OF PAIN MGMT. v. JOSEPH, 01-15764
California Business and Professions Code section 651(h)(5)(B), which restricts the use of the term "board certified" in physician advertisements, is not unconstitutional. Consistent usage of the term "board certified" informs the medical community and the general public, and physicians are not precluded from advertising their other qualifications.
