PROVIDENCE HEALTH SYS.-WASHINGTON v. THOMPSON, 02-35912

The exemption of 42 C.F.R. section 413.30(e), entitling skilled nursing facilities that qualify as "new providers" to full reimbursement, is ambiguous. Defendant's narrow construction of the exemption reasonably conforms to the wording and purpose of the regulation, and is given deference.
