United States Ninth Circuit

CARRICHE v. ASHCROFT, 02-71143

The Board of Immigration Appeals' "streamlining process," which bypasses traditional three-judge review, does not violate the due process rights of aliens, and petitioner's challenge to a specific decision to streamline is not reviewable as it is based on an alleged error in a discretionary hardship determination.
