PENG v. HU, 02-55852

A police officer was entitled to qualified immunity given the totality of the circumstances facing him at the time of plaintiff's arrest, thus dismissal of a 42 U.S.C. section 1983 claim arising from an arrest for robbery under California law is affirmed.
