ZHENG v. ASHCROFT, 02-70193

The Board of Immigration Appeals's interpretation of "acquiescence" under the United Nations Convention Against Torture, to require that government officials are willfully accepting of torture to their citizens by a third party, is contrary to clearly expressed congressional intent to require only "awareness."
