United States Ninth Circuit

WEBB v. SLOAN, 01-16855, 02-16253

Deputy district attorneys are final policymakers in Nevada for purposes of establishing municipal liability under 42 U.S.C. section 1983, thus a jury verdict in a claim alleging prosecution without probable cause is affirmed. District court applied the wrong legal standard for relatedness in computing a fee award under 42 U.S.C. section 1988.
