WYATT v. TERHUNE, 00-16568

The procedure used by a magistrate judge did not give a pro se prisoner litigant fair notice of summary judgment proceedings, in a challenge to the California Department of Corrections' hair length regulations. Dismissal of an equal protection claim is reversed where defendants failed to prove non-exhaustion under the Prison Litigation Reform Act.
