Although defense counsel had an actual conflict of interest which defendant did not validly waive, defendant failed to show that the conflict adversely affected representation to support an ineffective assistance claim. Prosecution's erroneous use of guilt-assuming hypothetical questions did not affect defendant's substantial rights.
