US v. HOLLOWAY, 01-10508

Conviction for violating the Federal Bank Robbery Act necessarily establishes the facts that would be needed for a conviction under the Hobbs Act. Thus, because prosecution under the Hobbs Act puts defendant in jeopardy again for the same offense and violates the Double Jeopardy provision, conviction reversed and indictment dismissed.
