United States Ninth Circuit

US v. MCCORMAC, 02-30020

The district court correctly denied defendant's request for a mistrial, despite her being held in contempt of court in the presence of prospective jurors, and properly calculated the amount of loss, for purposes of determining defendant's offense level, under the sentencing guidelines for fraud convictions, given defendant's intention not to repay a loan and to prevent the loaning institution from collecting the pledged collateral.
