United States Ninth Circuit
US v. STANLEY, 01-50734
Where a victim of a kick-back scheme suffered a specified monetary loss, and a defendant's resitution liability was erroneously capped, restitution payments by his codefendants of a sum less than the victim's total loss only reduced the victim's loss; they did not reduce defendant's restitution ceiling.
