United States Ninth Circuit

DEWITT CONSTR. INC. v. CHARTER OAK FIRE INS. CO., 01-36013/14

Alleged damage to a construction site from defective concrete piles was not "property damage" under commercial liability insurance policies, but damage to work of subcontractors, which had to be removed and destroyed because of the pilings, does qualify as "property damage."
