KONOP v. HAWAIIAN AIRLINES, INC., 99-55106

The unauthorized viewing of stored electronic communications on a secure web site does not constitute an "interception" under the Wiretap Act. A Stored Communications Act claim is viable where a "user" did not authorize third party access.
