MCDONALD v. MEANS, 99-36166/00-35002

A Bureau of Indian Affairs road (part of a state highway) constitutes a tribal road, thus a tribal court had jurisdiction to hear a claim for injuries resulting from negligence in allowing a horse to trespass on such a road. Tribe's motion to intervene was properly denied.
